1. About these terms

1.1 These terms apply to your use of the Away End app (the "App") and any Away End Plus subscription. The App is provided by Away End App Ltd, company number 17316412, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ ("Away End", "we", "us"). Contact us at contact@awayend.co.uk.

1.2 By creating an account and tapping "I agree", you accept these terms. If you don't agree, please don't use the App.

1.3 Our Privacy Policy explains how we use your personal data.

1.4 You also have to follow the rules of the app store you downloaded the App from (Apple App Store or Google Play). Section 13 contains extra terms for Apple users.

2. Who can use the App

2.1 You must be 18 or over to create an account. The App is designed for football fans in the UK and for UK law. If you use it from another country, you still keep any consumer rights that the law where you live gives you and that can't be excluded.

2.2 You need an iPhone running iOS 15 or later, or an Android device running Android 7.0 or later, and an internet connection. Data charges from your mobile provider may apply.

3. Your account

3.1Keep your sign-in details secure. You're responsible for what happens on your account.

3.2 Your username must not be offensive, impersonate anyone, or infringe anyone's rights. We may ask you to change a username that breaks these rules, or change it ourselves.

3.3 You can delete your account at any time in Profile → Delete Account, or at www.awayend.co.uk/delete-account. Deleting your account doesn't cancel a subscription bought through Apple or Google. Cancel it in your store account settings (see section 6).

4. Your licence to use the App

4.1 We give you a personal, non-transferable, non-exclusive licence to use the App on devices you own or control, for your own non-commercial use.

4.3All intellectual property in the App and its content belongs to us or our licensors.

5. How to use the information in the App

5.1The App is a planning aid, not an official source. Ground guides, kick-off times, travel times, routes, ticket and pint prices, away allocations and pub information come from our research, third parties and other fans. They can be wrong or out of date.

5.2 Before you travel, check with official sources: your club, the home club, rail and bus operators, and National Rail Enquiries. We're not responsible for missed trains, changed kick-offs, closed venues, or costs you incur because you relied on the App.

5.3 Pubs and venues shown in the App are not endorsed by us. Pubs may be home-fans-only, may restrict entry on matchdays, or may be subject to police or club restrictions. Always follow the instructions of stewards, police and venue staff, and drink responsibly.

5.4 Away End is independent. We are not affiliated with or endorsed by the English Football League, the National League, the Premier League or any club. Club names, and any other trade marks, belong to their owners.

6. Away End Plus subscriptions

6.1 The App is free to download and use. Away End Plus unlocks extra features, as described in the App when you subscribe, for example unlimited Ground Passport records.

6.2Price. Away End Plus costs £4.99 per month or £49.99 per year, including VAT. The price shown in the app store at the time of purchase applies.

6.3Payment and renewal. Apple or Google take payment. Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before it ends.

6.4Cancelling. Cancel at any time in your Apple or Google account settings. You'll keep Away End Plus until the end of the period you've paid for.

6.5Price changes. We'll tell you about any price increase in advance, and the app store will ask for your agreement where it requires it. If you don't agree, you can cancel before the new price applies.

6.6Your 14-day cancellation right. UK law usually gives you 14 days to change your mind about a digital purchase. Away End Plus features are available straight away. So when you subscribe, we ask you to agree to immediate access and to confirm that you understand you then lose the 14-day right for that period.

6.7Refunds. Refund requests are handled by Apple or Google under their policies. This doesn't affect your legal rights if Away End Plus is faulty or not as described. In that case, contact us too.

6.8Free trials and offers. If you get a free trial, promotional period or offer code, it converts to a paid subscription at the end of the free period unless you cancel before then. Promotional entitlements (such as waitlist rewards) end on the date shown when they're granted.

6.9If you downgrade. If Away End Plus ends, you keep your data, but Plus-only features are locked. For example, Passport records beyond the free limit are locked, not deleted, and unlock again if you resubscribe.

7. Badges, rewards and competitions

7.1Badges, ranks and rewards have no cash value and can't be transferred or exchanged.

7.2 Any competition or waitlist will have its own rules. We publish them when it starts, and they take priority over this section.

7.3 We may withdraw a badge or reward obtained by cheating, fake accounts or misuse of referral codes.

8. Your contributions

8.1 You may send us content, such as votes, ratings, matchday feedback, suggested corrections, messages, and Passport notes and photos.

8.2 You keep ownership of your content. You give us a free, worldwide, non-exclusive licence to use votes, ratings, feedback and suggestions to improve and publish Away End's guides and data, in combined and anonymous form. Passport notes and photos are private to you. We use them only to provide your Passport.

8.3 You must not submit content that is false, unlawful, offensive, or that infringes anyone's rights. We may remove content that breaks these rules.

9. Links and third-party services

9.1 The App uses third-party services, such as maps and routing, and links to third-party websites, such as ticket and travel sellers.

9.2 Some links are affiliate links. We may earn a commission if you buy through them, at no extra cost to you. We only include links we think are useful to away fans.

9.3 We're not responsible for third-party sites, products or services. Your purchases from them are governed by their own terms.

10. Changes, availability and suspension

10.1 We may update the App and change or remove features. If a change significantly reduces what you've paid for with Away End Plus, we'll tell you, and you can cancel and ask us for a refund of the unused part.

10.2 We aim to keep the App available but can't promise it will always work without interruption.

10.3 We may suspend or close your account if you seriously or repeatedly break these terms. We'll tell you why unless the law prevents us.

10.4 We may update these terms. If we make significant changes, we'll tell you in advance in the App or by email. If you don't agree to the new terms, you can stop using the App and delete your account.

11. Our responsibility to you

11.1 If we break these terms, we're responsible for loss or damage you suffer that is a foreseeable result of that breach or of our failure to use reasonable care and skill. We're not responsible for loss that wasn't foreseeable.

11.2 The App is for personal use. We're not responsible for business losses, such as lost profit or lost business opportunity.

11.3 We don't exclude or limit our liability where it would be unlawful to do so. That includes death or personal injury caused by our negligence, fraud, and your statutory rights under the Consumer Rights Act 2015 (including the rights to digital content that is of satisfactory quality, fit for purpose and as described). 11.4Section 5 explains the limits of the travel and venue information in the App. Your decisions about travel, venues and alcohol are your own.

12. Complaints and disputes

12.1 If you have a problem, email contact@awayend.co.uk. We'll try to resolve it quickly.

12.2 These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.

13. Extra terms for Apple users

If you downloaded the App from the Apple App Store:

• these terms are between you and Away End, not Apple. Away End, not Apple, is responsible for the App and its content;
• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to meet any applicable warranty, you can tell Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation to the extent the law allows;
• Away End, not Apple, is responsible for handling any claims about the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection claims;
• Away End, not Apple, is responsible for investigating and dealing with any claim that the App infringes someone's intellectual property rights;
• you confirm you're not in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. General

14.1If a court finds any part of these terms unenforceable, the rest still applies.

14.2 We may transfer our rights and obligations under these terms to another organisation, for example if the business is sold. Your rights won't be reduced as a result. You may not transfer yours.

14.3If we don't enforce a right straight away, we can still enforce it later.

14.4 No one other than you, us and (for section 13) Apple has any rights under these terms.
